North Dakota League of Cities Crossover Update

 Reminder: There is no North Dakota League of Cities Legislative Update Call on Friday, February 26

 

The North Dakota Legislature has finished the first half of its work with North Dakota Senators finishing on Tuesday, February 23, and North Dakota Representatives finishing on Wednesday, February 24. Crossover is the day when all House bills that have passed must be sent to the Senate and all Senate bills that have passed must be sent to the House. Study resolutions and proposed constitutional amendments do not need to cross over to the other chamber until March 10.

Week of February 22

The League did not testify on any bills this week as most of the Legislature’s time was spent either on committee work or on the House or Senate floor voting on bills.

Here is a summary of the results of the vote on the bills that were pending from the League’s High Priority list:

HB 1222	Amended Passed House 87-6	This bill relates to non-conforming structures.
HB 1248	Amended Passed House 83-11	This bill relates to regulating firearm and dangerous weapon during an emergency and city zoning ordinances regulating firearms and dangerous weapons. Contains an emergency clause.
HB 1275	Failed House 14-76	This bill relates to using Legacy Fund bonding to fund several projects and grant programs.
HB 1324	Failed House 17-77	This bill relates to eminent domain proceedings.
HB 1331	Failed House 5-87	This bill relates to initiating and repealing ordinances.
HB 1367	Amended Passed House 92-2	This bill relates to studying referral of political subdivision budgets.
HB 1379	Amended Passed House 93-0	This bill changes distribution to monthly for state aid.
HB 1380	Amended Passed House 71-22	This bill creates a legacy earnings fund and splits the money between several priorities.
HB 1419	Amended Passed House 75-19	This bill relates to allowing collection of an infrastructure fee in lieu of special assessments.
HB 1425	Amended Passed House 85-8	The bill creates the legacy infrastructure revolving loan fund and sets the priority for portion of legacy funds to be invested in state.
HB 1464	Amended Passed House 62-32	This bill relates to the gas tax and fees for electric vehicles.
HB 1495	Amended Passed House 75-19	This bill relates to authority under emergency powers.
SB 2040	Defeated Senate 7-40	This bill creates procedure for the public finance authority to request appropriation from legacy fund revenue for municipal infrastructure fund, county and township infrastructure fund, school construction assistance fund, housing incentive fund, and road and bridge grants.
SB 2139	Amended Passed Senate 39-8	This bill creates the ability for a city to use a neighborhood zone.

 

Also, city officials should be aware that HB 1420 that creates an adult use marijuana system in North Dakota passed the House 56-38 and HB 1501 which creates a tax on adult use marijuana passed the House 73-21.

 

Week of March 1
